NickRanks Terms of Service

Effective Date: May 1, 2025

1. Acceptance of Terms

By using NickRanks+CRM, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform.

2. Services Provided

NickRanks+CRM is a business and marketing automation platform powered by GoHighLevel. We provide CRM, automation tools, funnel/page builders, scheduling, SMS/email campaigns, and other digital marketing utilities to help businesses grow.

All services are provided by NickRanks, not directly by GoHighLevel. Support and billing are managed by NickRanks.

3. Use of the Platform

  • Use NickRanks+CRM for lawful, business-related purposes only
  • Comply with all applicable laws, including TCPA, CAN-SPAM, HIPAA, and GDPR
  • Avoid spam, abuse, misleading practices, or illegal content
  • Secure your account credentials and immediately notify us of unauthorized use

4. Account Ownership & Data

  • You own your data (contacts, messages, campaigns, etc.)
  • NickRanks owns the platform license and access infrastructure
  • We reserve the right to suspend access for non-payment or violations

5. Billing & Payment

  • Subscriptions are billed in advance (monthly or annually)
  • Usage-based fees (e.g., SMS, phone, email) are charged separately
  • All payments are non-refundable. No credits for unused time
  • Cancel via your dashboard or email support@nickranks.com

6. Support

Support is provided directly by NickRanks. Contact us at support@nickranks.com. Typical response time is within 1 business day.

7. Third-Party Services

NickRanks+CRM integrates with third-party platforms (e.g., Google, Stripe, Twilio). We are not responsible for third-party outages, data practices, or compliance.

8. Termination

  • We may suspend or terminate your account for non-payment or violations
  • You may cancel at any time by written notice or from your dashboard

9. Limitation of Liability

NickRanks is not liable for:

  • Loss of data or profits
  • Service interruptions
  • Regulatory violations caused by your actions

Our maximum liability is limited to the amount paid by you in the last 30 days.

11. Changes to These Terms

We may update these Terms at any time. Continued use of the platform means you accept the updated Terms.

12. Artificial Intelligence (AI) Acceptable Use Policy

By using AI-powered features in NickRanks+CRM, you agree to the following:

  • Lawful Use: Do not use AI for illegal, misleading, harmful, or unethical activities
  • Disclosure: Inform users when they’re interacting with AI (e.g., bots)
  • Data Protection: Do not input sensitive or regulated personal data into AI features unless compliant with applicable laws
  • Responsibility: You are responsible for reviewing and managing AI-generated content
  • Enforcement: Violations may result in account suspension or restricted access

13. Sub-Account Ownership, Data Access & Transfers

13.1 Platform Access
Your account is a sub-account under NickRanks’ platform license. You are granted access via a subscription and do not own the software license or infrastructure.

13.2 Data Ownership
You own your content and data within your NickRanks+CRM account. However, NickRanks controls the sub-account infrastructure and access permissions.

13.3 Account Transfers
Sub-accounts are non-transferable without written consent. You may not migrate your account to another agency or platform provider without prior approval from NickRanks.

13.4 No Direct GHL Transfers
GoHighLevel does not manage or migrate NickRanks sub-accounts. All account requests must go through NickRanks directly.

13.5 Inactivity and Abandonment
If your account is inactive for 30+ days and we are unable to contact you, NickRanks may suspend or delete your account without liability.

13.6 Transfer Fees
If a transfer is approved, fees may apply. You will be notified before any migration is initiated.
